Appeal denies the alleged victim’s story
The appeal denies that the Brazilian closed the door of the toilet, where he allegedly had the sexual assault, and relies on the images captured by the cameras of the premises to claim that the girl entered two minutes after he did, «without Dani Alves letting her pass or opening the door».
The aggression took place outside the limits of the cameras
The woman has denounced that the alleged aggression occurred once inside the bathroom, where there are no cameras, but Alves’ defense points out that the complainant has described that previous moment «as lived in a climate of terror, dread or microcosm of domination, a scenario that the images disprove in the most radical way», assuring that there was no «environmental intimidation» to bend the will of the alleged victim.
The images would conflict with the complainant’s account
According to his lawyer, the images «conflict and contradict the description given by the complainant», after which he also questions the woman’s explanation of what happened inside the bathroom, which is not recorded.
Provisional release sought
With this appeal, Martell hopes to obtain provisional release on bail for Alves, and offers to comply with several measures to ensure that he will not abscond: among others, he is willing to wear a telematic bracelet that will geolocate him.
Alves will not leave Spain
He has also proposed to the court that he be obliged to appear in court periodically, «even daily», surrender his passport, be prohibited from leaving Spain while the case is being investigated and that a restraining order be imposed on him to stay away from the complainant.
